Unfiled IRS Tax Returns, sometimes called Back Taxes or Back Returns:

If you are behind in filing your tax returns, you are taking a huge risk that is out of proportion to the consequences of fixing the problem.  No matter how many years behind you are, get up to date.

No more sleepless nights, fear of the mailman, fear of the knock on the door.  End it. NOW!  

NON-FILING OF TAX RETURNS

This is serious business.  Failing to file your tax returns places you in a position where you will be difficult to help.  That is so unnecessary. If you do not file, the IRS will conclude that you are one or more of the following:

  • A tax protestor (even though they can't use that term anymore)

  • Attempting to evade taxes by not filing

  • Hiding Income

  • Participating in the Underground Economy

  • Participating in illegal activities such as

    • Organized Crime

    • Prostitution

    • Drug Dealing

    • Smuggling

    • Money Laundering

In fact, most people end up non-filers unintentionally, but that won't matter to the IRS.  You will be treated as a criminal, threatened with a real possibility of prosecution.

What happens to people is that they are unable to file one year, or unable to pay if they do file their return, or perhaps a divorce or illness takes priority and they go past the deadlines and stop thinking about it.  Frequently the IRS doesn't say anything or send a "reminder." Next year rolls around and the taxpayer is confused about what to do.  He or she is afraid to file for fear of getting in trouble for skipping the last year, so procrastination sets in and nothing is filed for several years.  Then the IRS discovers the situation and files substitute returns and proceeds immediately to collection.

Reasons to file your tax return even if you cannot pay

  • You avoid the failure to file penalty

  • You avoid substitute returns filed by the IRS.

  • You get to take your adjustments, deductions, and exemptions which are denied to you on  a substitute return (filed by IRS for you which is inevitable if you receive W-2 or 1099 income).

  • You start the statute of limitations clock ticking for audit of your return (3 years from tax assessment date).

  • You start the statute of limitations clock ticking for collection of the tax, interest, and penalties on your return (10 years from assessment).

  • You make your taxes, interest, and penalties (1040) eligible to be discharged in Chapter 7 Bankruptcy (about 3.5 years after filing each if assessed promptly).

  • You stay in good graces with the IRS.  Not a small thing when an offer in compromise is subject to IRS discretion.

  • Solving problems is a whole lot easier.

  • You might get jailed for failing to file, but not for failure to pay unless you hide income. 

Since the taxpayer hasn't been filing or corresponding with the IRS, any notices could go to an old address and the taxpayer could be UNAWARE OF THE IRS COLLECTION ACTIVITY UNTIL IT IS TOO LATE TO PROTECT PAYCHECK, BANK ACCOUNT OR POSSESSIONS.

Although we see few prosecutions for failure to file, WE DO SEE THEM.  Please don't take the chance.  We can file your old tax returns quickly and accurately even if you are missing information.  Often, the liability disappears after taxpayer returns are filed replacing the substitute returns filed by the IRS.  If not, you have solutions available that we can determine and implement thus getting the IRS out of your life.  You will no longer go to sleep worrying about this, then wake up to it too. 

REMEMBER---THE IRS WILL FIND YOU WHEN YOU LEAST EXPECT IT AND ARE LEAST PREPARED TO SOLVE THE PROBLEM.

Whether or not you hire me is not the big issue here.  I am here to help.  Enough people will hire me to keep my rent paid.  The big issue here is don't ignore this problem, it will not go away.  Examples:

  • A doctor who didn't file for two years went to JAIL!!! (San Antonio TX)  I saved him money on an offer in compromise, but I cannot give him the year in jail back.

  • Another Doctor client owing over $500,000 was never prosecuted.  (Hey I never said they were fair!)  He got a break from the IRS and paid  a fraction of what was owed.

  • An IRS manager working on the border in South Texas got involved in the drug trade, got caught by DEA, turned in all his dealers and cohorts, who lost everything they owned AND went to jail.  The IRS manager was not prosecuted and was allowed to RETIRE WITH OUR TAX DOLLARS PAYING HIS PENSION.  (HARLINGEN TX, IRS OFFICE).

Do not let the base unfairness of the tax system and it's collectors ruin your life, prevent you from owning a home, or worse, sending you to jail.  Call me. Let me help you.  I might scare you a little, but better me than the IRS taking your paycheck or worse.
